b. Asset/Equity Transfers.

If we become involved in a merger, acquisition or other transaction involving the sale of some or all of ELB Learning’s assets or equity, information on customers and Site users, including personal data collected from you through your use of the Site and its services, could be included in the transferred assets, subject to applicable law. Any such third-party data processors are and/or will be subject to contractual agreements to ensure that they only process personal data provided by ELB Learning in a manner consistent with our obligations under GDPR requirements as more fully described and made accessible to you below. ELB Learning remains liable under such Principles if its agent processes your personal data in a manner inconsistent with the Principles, unless we can prove that we are not responsible for the event giving rise to any damage.

d. Marketing Purposes.

We will occasionally use your personal data for our own marketing purposes, subject to applicable law, and subject to your clearly indicated right to opt-out of receiving any such communications from us. If you are a resident of the European Union, we will require your express consent in order to be able to send your marketing-related communications. See the expanded Marketing section below.

e. Usage Data.

We may share Usage Data and other aggregated, anonymized information that shows patterns, trends, preferences, and other collective characteristics of our customers and Site users, with third parties. Disclosure of this information helps us and our marketing partners evaluate and tailor our communications, advertisements, services and general business practices to the needs of our Users.

You may update, supplement, or change any information you previously provided to Third Power Training through this Site using the Talent Login to access your profile, following your Username and Password authentication.

Third Power Training employs a variety of physical, technical, and organizational security practices and measures designed to guard against the loss, misuse, unauthorized access, disclosure, alteration, or destruction of Personal Information submitted through this Site. If you are selected as a member of the Third Power Training team, Third Power Training will have the right, to the extent that Third Power Training deems it appropriate in its sole discretion, to provide your Personal Information to third parties in connection with potential consulting engagements for which you may be considered.

We will not otherwise sell or provide your Personal Information to third parties for their use without your express consent, except that Third Power Training may disclose your Personal Information as we deem necessary, in our sole discretion, to comply with the law or governmental regulation, to respond to a judicial order or decree or a request by a governmental authority, or in connection with litigation or some other form of dispute resolution proceeding involving Third Power Training’ administration of this Privacy Policy or an alleged violation of the Terms & Conditions of Use of this Site.
